I got an email from the "Whale Enforcement Unit" (Transport Canada)

What other reason could it be other than they are sick of seeing fish boats clothing up their view? They would rather their view be untouched BC waters.

I've never seen freighters anchored in that channel. Pretty high flow there too.


Go have a drive past that section, and the other section along the south western side of saturna. Some high end homes there. That's the reason right there. Someone has a pass
 
So there's one installed on Pender bluffs, whether or not it was utilized in the case i stated but, like I said my friend has been issued a $2000 fine based on a non AIS observation
Spoke with TC staff at the boat show today. Quite personable /friendly bunch and were happy to answer questions... for the bluffs, they apparently have several theodolites installed and volunteers manning them.

So they are getting boat location via triangulation, which i suspect is more accurate than GPS/ais data .. but they do harvest ais as well.

That's super interesting, I wonder
1/volunteers know each other and could collaborate or corrupt data as they have an agenda
2/They appear to be unstabilized radar units, easily unreliable data
3/AIS and radar work on different principals, mostly not producing the same data
4/I would challenge the data as unreliable in court. But...the way they have set it up you cannot have your day in court as its an AMP I understand

I wonder if you refused to pay the fine would they have to take you to court to recover it and inadvertently give you your day in court. If not,were they to take recovery action outside of court, would they be required to justify it and give you an opportunity to dispute it then? Seems pretty unusual that you can be fined without validated or contested proof. Any Lawyers here?

Look up AMPS or Administrative Monetary Penalties it's the new way of government business. If you didn't pay it would most likely go in the usual way of government repayments such as tax rebates or pay garnishment.

From Transport Canada site, not sure how successful the appeals actually are but it looks like they are available.

“The AMP scheme includes review and appeal procedures. The person or vessel must either:

  • Pay the full amount, or
  • Request a review of the charge or penalty with the Transportation Appeal Tribunal of Canada”
 
It is odd that a main member of the NGO movement and advocate lives on this island. Just look at it from 1000ft view.

Why does the island in particular have the most fishing restrictions out of any on island? And it also has most tattletailing public on its shores? Its like the NGO are putting a moat around a castle 🏰 with taxpayers money.

Nope not weird or anything. Must be an oversight....

How unfair to citizens that live on island.
