I like how they gave back the boat because it was in his parents name. total b.s. if he did that in the states I would like to see the fines then.
 
60-80 rockfish is probably a 2-3 day snack for a seal[:o)];)And we all know how over populated our seal population is.
 
I have been told by several Saturna Island residents that they witnessed and reported some flagrant law breaking by sport fishers on the south end of the island. They watch the violations happening right in front of their waterfront homes. I hear DFO are challenged by being unable to respond fast enough after a violation is reported unless they go and sit and wait (often too expensive). :(

Apparently, most of the trouble is from US origin boats that come across the mid-strait border to fish and hover in the area then go back home. Fishing within an RCA, too many ling on board, rockfish highgrading, etc. are all taking place there. [xx(] The one that got me was apparently a certain US boat often comes and fishes for a couple of hours, limits on rockfish and lings then buggers off home only to comes back for another full limit a few hours later. [xx(]

Maybe this will get the word out that they can't get away with it all the time!

P.S. allowing the return of the perps boat as it was registered to someone else is likely to spark others to adjust their boats ownership papers for protection from the long arm of the law - I think it was an error to return their boat.

I still don't understand how an American guide can work the Canadian waters like that.
Or on the Canadian portion of Swiftsure.
Is there a "treaty" or a rule-of-the-sea in place?

With respect to this TC article on Saturna Island, I simply do not know for sure. My guess is DFO chose to ignore that aspect of the case against the US Charter Operator as it is a business licensing issue not a Fisheries Act violation. If the RCMP do not want to get involved it is a time waster for DFO enforcement.

Re: Swiftsure - the stipulated rules for non-residents doing business (as a fishing guides or charter) in Canadian waters IF they ply their trade WITHIN 12 Nautical Miles from shore is that they MUST be a registered Canadian business. Where the challenge on Swiftsure comes into play is the bank is greater than 12 NM from shore and RCMP won't look at it. But DFO and RCMP are trying to reduce the impact on halibut catch where US sport fishing boats simply come into Cdn waters and bugger off back to the USA with Cdn halibut without landing in Canada. The issue is that those Cdn halibut which go to the USA go against our stingy recreational 12% halibut TAC, making Cdn Joe public have even less available.

Plus US anglers from Washington State can not buy a salt water fishing license on the internet so most of that problem has gone away. The charter operators need people with Cdn licenses bought in Cda to go fishing in Cdn waters.

I think it is great that DFO was able to get a successful conviction, but also feel the fine was too lenient. With regard to the comment on the decimation of rockfish stocks, having grown up fishing the local waters, it is my impression that rockfish (and lingcod) stocks were fairly abundant prior to the live rockfish fishery that was present locally during the late 70's and 80's. Commercial fishers worked this area pretty hard to supply the live fish market in the lower mainland. When you look at the landing statistics compared to what was being caught in the sport fishery at the time, there was quite a discrepancy. Now the stocks are severely depleted and DFO is pushing the panic button with both hands. Sound familiar?

Here's a story about that lodge you two are talking about.
I talked to a fisheries officer who was on an undercover operation and asked around winter harbour where to fish for Halibut(remember undercover)
A fella said it's easy, just follow those guy's out in the morning and if you can't do that just head out that way and when you start seeing dead snapper floating everywhere...just follow the trail.
So they did.
As they approached they saw three vessels in close proximity and counted 14 dead snapper floating.
when asked why all the dead snapper, one of the guides said "we've simply got our limit but were looking for halibut...they are down there it just takes time".
They videod the group for a bit and added it to the file
It's only a matter of time...

Was told when we were fishing up there a couple years back that is the technique. Drop the pick with chum. Clean out the snapper, then come the ling, clean them out then come the halis.

Told to do this as this was how they get the 'hawgs'.

Well we didn't get a single hali as we would move after hitting the limit of yelloweye rather than float the poor bastards. Not a very forward thinking guide mentality thats for goddamned sure. Hope it comes crashing down before all the bottom fish do in that area.

If guides/lodges are ethical they can catch all the species customers want with minimal by-catch. I fished offshore this summer at Nootka with 2 guides who were working for one of the lodges. They allowed me to tag along for the morning on a hali, snappper and ling outing. We started at the chicken ranch, quickly getting those in short time. (left room for 1 hog later on) We all moved to the snapper/ling grounds and spent an hour there. I took 3 nice yellow eye up to 17 pounds and a 25 pound ling. Then we moved to the hog hole for the tide change. I ended up with a 41 pound hali, after loosing one around a hundred pounds at the boat. The only by-catch for us was a couple China Rockfish which we kept even though amount of recoverable meat was minimal. We then moved over to the Bajo for the afternoon flood and took 37, 34, 27, 23 and 20 pound springs.
Happy customers and no wasted floaters! The guides I followed have taken the time to learn the different spots and now move around keeping their gear fishing only wanted species.

Because its not true, those guys move if the snapper are thick. Also they fish a huge 50 mile stretch of water, no way would three boats be anchored close to each other.

If you want to see dead snapper follow a long line boat in from triangle island. [xx(]
