I think throwing out the word “Sparrow” without including background on the full scope of the Sparrow decision only tells half the story. The full implications of the Sparrow decision throws even focus on whether of not the DFO can pass the Red Faced Test:

I think even DFO at this point would have difficulty making the argument that IFS is not an Extreme Conservation Concern and based on that, should appeal to the Court to make the Musqueams cease and desist river netting operations until the peak migration of remaining IFS Is finished for the season

Like I said, the fisheries minister has already signed off on the closure window and it ended November 1.

Any changes to that is now a minister political decisions with First Nation advice.

I do think an ENGO could go to court on this to push for a closure that would cover the whole migration window. Think it’s like 60-80 days or something was the original recommendation.

Just don’t think there is any will from the liberal government and First Nations to extend it. Like bob said in a previous blog there is probably more pressure to reverse the closure window.

There ya go, you said it loud and clear. Even when they knew the escapement was going to come in short on sockeye they still let them fish even after they got a huge qouta increase.
