Skippers needed in Sooke - July 3rd

Because of our date change (now July 3), we have ended up in a bit of a boat crunch for our Consultant's derby. Wondering if any out there are willing to help out for our event as a skipper (out of Sooke Harbour Resort). Its an invitational social derby put on by the civil engineering community used to raise funds for sooke salmon enhancement. If you can take people out on your boat, you will get a free ticket to the event, be eligible for all the prizes, enjoy the catered food, free beer, live band, fine women [:p], and we ask the guests to chip in for gas/bait etc. Min $20/head, ideally min $100 for larger boats. Obviously it's at their discretion and we can't guarantee that end of the deal. Most will likely need gear as well, but you can strictly run your fishing rod and they can rotate turns on the other one. Its a fun event, has been prizes for everyone to date (and 'should' be again this year), and we have made large donations the last few years to the hatchery. Will the boats need to be Transport Canada certified? I understand that in order to take guests out and accept gratuities and or donations for gas, bait, and other expences you must be TC certified.

you must be a member on that 'other site'...there was quite a lengthy debate on this subject there recently...I call complete BS on being considered a guide by TC or your insurance if a fishing partner chips in for gas...
 
yeah, that seems a little much - IF that were true, every single boat owner would have to be transport canada certified unless we only ever fished by ourself or never accepted $ for costs.

Don't know about you, but every time I go out with a buddy, I at least chip in for the launch, or grab the bait...etc etc

I would say its more along the lines of the 'interpretation' of 'receiving payment'. Payment to me does not imply paying for the launch or chipping in for gas. Payment to me implies commercial entity where a transaction has occurred for the service.

Find me something documented that says clearly otherwise and it will be something to discuss.

Of course you would need whatever documentation required just to boat...pleasure craft operators card etc etc

I guess nothing would surprise me these days - after all, has everyone taken their test that gives them the right to use a radio???

I would also have to challenge that one, but it really is all “how” a “guest” was to answer questions! I can and most certainly do collect funds from “guests” for “shared costs”; including “my fair share” of those costs. I do also admit, one of my worst hears would be if one of “my guests” made the statement, “Yes, I paid $xxxx number dollars! That answer opens up a whole lot of issues between “cost” and “amount collected”, and I personally would prefer “not” to go, as that becomes “my” responsibility to “prove”. I make it very clear upfront, “I am not a guide” and the monies collected are only to offset “costs”! I have checked… it is not an insurance issue at that point! If they don’t want to contribute to a fair amount of “my costs”, then I do have a decision to make – as so do they!
 
Is this the final last time for dates as the last group cancelled because of all the changes???

Yes Wolf, last change regardless of the DFO decisions (they are fixed now anyway). Didn't your group already have to drop out because they had to cut back on costs, not because of the date move? The Victoria Emco office is still attending.
 
As stated in the SVOP guidelines. Section 1(b) The definition of "passenger", as found in the Canada Shipping Act is: "passenger" means a person carried on a ship by owner or operator, other than a person carried on a ship (that is not a safety convention ship) who is:
(i) the master, a member of the crew or a person employed or engaged in any capacity on board the ship on the business of that ship, or
(ii) a guest on board the ship, if the ship is used exclusively for pleasure and the guest is carried on it without remuneration or any object of profit,
(iii) a person carried on a ship in pursuance of the obligation on the master to carry shipwrecked, distressed or other persons or by reason of any circumstances that neither the master nor the owner could have prevented, or special personnel.

I will leave you guys to figure out what it all means.. Just finished that sleeper of a course today.. If anyone has a boat in the water and plans to guide, YOU NEED IT!!!..;)dirty
 
Looks like a poorly drafted piece of legislation to me, but then I am not a lawyer. A friend or fishing partner in this case chipping in for gas would not even come close to remotely covering actual costs of a day out fishing so there would not seem to be any object of profit but then there is the interpretation of remuneration. To put this in perspective, consider the car pool lane in Vancouver. On any given day there are thousands of people heading into the office with a friend who is driving and the others chipping in for gas or parking. Are they operating as a taxi service ? - is their insurance valid? Keep in mind government encourages car pooling to ease congestion and pollution.
In a case like we are discussing here there is the greater good of a Derby run primarily to provide funds to a Hatchery/non profit society. In my view the sport fishermen who donates his time and boat to a worthy cause such as this is actually making a donation to a non-profit society even if 10% of their costs are shared. Common sense should prevail, but then again, we are talking about government and insurance companies. Has anyone called Transport Canada and asked them outright?

This is a really dumb debate though ! If Transport Canada ever busts a guy for passing the hat for fuel or beer, I'll be heading down to the Parliament buildings with my gas can!

amen...makes u wonder why you spend 100+ hours trying to organize an event like this just to get into discussions about whether people can legally chip in for the cost of fishing! If its a concern for anyone, well, feel free to donate all your time and absorb all related costs then. The guests will certainly appreciate that even more ;)
 
i know the fishing wkend for kids (pink festival)demands you have the right insurance, but in the case of this derby who reallys cares, unless someone tries really hard to make an issue of it nothing will ever happen
otherwise you would only ever see boats with the skipper on board, cant believe that one persons dumbass question has turned this post into this
lets get back to the derby talk and who can support this great LOCAL cause

sigh...ok, found the forum/thread where the spitting about this began. Whatever....i'm done with it. We would love it if people would donate their time and boat for a great local event that has given back over $1000/chinook caught, but I'm not about to get in the pissing match like they had over at that other joint.

Hope everyone with a VHF has their ROC, heaven forbid there may be people out there breaking the 'law'.....
 
I am iffy for guest skippering for this event due to the date change. But I can tell you all ... it's a good time and highly recommended. Nice bunch of guys (and gals), good food, free beer!, and a well-run derby.

If you're free that day, and want to go fishing, this is a good way to do it.

[and no, I did not "profit", other than meeting a couple new fishing buddies and winning a reel draw prize... :D ]
 
Hey mlaag, there is no fix number. You tell us how many you feel comfortable with and let us know your preferences e.g old crusty guys who smoke or young good looking girls who like to party etc...:D and then we will try to find a match from the participants looking for a skipper. Honestly, you tell us what suits you best and we try to work with that. We want you to enjoy this event too. So far I have not heard bad feedbacks from the external skippers and we have many repeaters... Just this year we are challenged with this last minute rescheduling which cost us a number of participants and skippers.

the lessor of either the boat passenger allowance, or what the skipper/owner desires! Often 2 people will work off 1 fishing rod, taking turns each time there is a hit...
