Robert Janes, legal counsel for the First Nation, said in 2016 when the lawsuit began that one of the conditions that goes with any expropriation of land for railways is that once it’s no longer needed or used for railway purposes, it goes back to the original owner.

Perhaps this will motivate governments to get with it and upgrade the E&N before the opportunity is lost. To replace that right of way, if it were lost, would be very difficult and expensive. An efficient Island rail service would take pressure off the highway and could provide a needed commuter service, especially on the south end.

CP was 'using' the rails until they city pieced them off then they faded from the picture PDQ-that's my backyard and I cycle to work along there most days.
Perhaps this will motivate governments to get with it and upgrade the E&N before the opportunity is lost....
That is so not going to happen-railways are hideously expensive to operate-my Brother who was an executive with a large eastern RR was with me on an Island fishing trip and spotted a logging railway-he couldn't believe they used such an inefficient method of transport/made any money at all since building & using roads is so much cheaper.
